Terms of Service
These terms are a legal agreement between you and GemRate Labs (“we,” “us,” “our”) covering your use of gemratelabs.com and related services.
By creating an account or using the service, you agree to these terms.If you don’t agree, don’t use the service.
1. The service
GemRate Labs provides tools for collectors of sports cards and trading card games, including AI-assisted grade estimation, collection tracking and valuation, market research, submission tracking, set registry, and listing generation.
We may change, add, or remove features at any time.
2. Your account
You must be at least 13 to use the service and at least 18 to purchase a subscription.
You’re responsible for keeping your password secure and for everything that happens under your account. Tell us promptly at Contact@GemRateLabs.com if you suspect unauthorized access.
One account per person. Don’t share credentials or resell access.
3. Subscriptions and payment
Tiers. We offer Free, Standard, and Premium tiers with different feature limits. Current pricing is on our pricing page.
Billing. Payments are processed by Stripe. By subscribing you authorize recurring charges to your payment method.
Auto-renewal. Paid subscriptions renew automatically at the end of each billing period — monthly or annually — at the then-current rate, until you cancel.
Cancellation. Cancel at any time through your account settings or by emailing us. Cancellation takes effect at the end of your current billing period. You keep access until then.
Refunds. If the service isn’t working for you, contact us within 30 days and we’ll make it right.
Price changes. We’ll give at least 30 days’ notice before changing subscription prices. Changes take effect at your next renewal.
Usage limits. Tiers include limits on grades, collection size, and other features. We may adjust these with notice. We may throttle or suspend accounts whose usage substantially exceeds normal patterns or burdens our infrastructure.
4. AI grade estimates — important
Grade estimates are estimates, not grades. Our AI analyzes photographs and produces an estimate of how a card might grade. That is fundamentally different from a professional grading service physically examining a card.
We do not guarantee that any card will receive any particular gradefrom any grading service. Professional grading involves physical inspection, proprietary standards, and human judgment that image analysis cannot replicate. Professional grading is inherently subjective. The same card may receive different grades from different grading companies—or even from the same grading company on different submissions. Our estimates are predictions only, not guarantees.
Accuracy varies. Estimates depend heavily on photo quality, lighting, and angle. Cards already in holders are especially difficult to assess accurately, because glare and imperfections in the plastic can be mistaken for defects on the card. Accuracy is also affected by cropping, focus, lighting, shadows, glare, image compression, camera quality, sleeves, top loaders, and scanners. Even excellent photographs cannot reveal every defect visible during an in-person inspection.
We do not authenticate cards. GemRate Labs does not determine whether a card is genuine, counterfeit, altered, trimmed, recolored, restored, cleaned, pressed, or otherwise modified. Our AI may not detect these conditions.
Submission decisions are yours alone. If you submit a card based on our estimate and it receives a different grade, we are not responsible for submission fees, shipping costs, grading costs, lost value, or any other loss. You accept that risk when you decide to submit.
Artificial intelligence systems occasionally produce incorrect, incomplete, or inconsistent outputs. Any AI-generated descriptions, listings, recommendations, analyses, valuations, or other outputs are informational only and should be independently verified before making purchasing, selling, grading, or investment decisions.
5. Valuations and market data — important
Valuations are estimates, not appraisals.
Our valuations combine active marketplace listings with real sold prices where available. Asking prices typically run above actual sale prices, sometimes substantially — sold-price data is more accurate where we have it, and cards marked Confirmed have been verified against real completed sales. We disclose confidence levels and listing counts where available, and you should weigh them.
Where we have limited data, valuations may be inaccurate or unavailable. Cards with few comparable listings. Population reports, newly graded examples, newly discovered inventory, and changing market conditions may materially affect values over time.
Cards with few comparable listings are harder to value and we may decline to price them rather than guess.
Nothing on this service is financial or investment advice. We are not appraisers, brokers, or financial advisors. Do not rely on our valuations for insurance, tax, estate, legal, collectible investment, or investment purposes without independent professional verification.
Buy, sell, and submit decisions are yours. We are not liable for losses arising from decisions made using our data. We are also not responsible for inaccuracies originating from third-party marketplaces, pricing providers, or external data sources.
6. Disclaimers and limitation of liability
Users are responsible for maintaining backups of their own collection information. While we take reasonable measures to protect data, we cannot guarantee against loss.
We do not warrant that the service will be uninterrupted, error-free, or that data will be accurate or complete.
Some jurisdictions don’t allow certain exclusions, so parts of this may not apply to you.
7. Your content
You keep ownership of everything you upload — card images, collection data, and notes.
By uploading, you grant us a non-exclusive, worldwide, royalty-free license to store, process, display, and transmit that content solely to provide and improve the service. This includes transmitting card images to third-party AI providers for analysis, as described in our Privacy Policy.
You represent that you have the right to upload what you upload and that it doesn’t infringe anyone’s rights.
This license ends when you delete the content or your account, except for copies retained in backups or as legally required.
8. Acceptable use
Don’t:
- Scrape, crawl, or use automated tools to extract data at scale
- Reverse engineer the service or attempt to extract our models or prompts
- Resell, redistribute, or commercially exploit our data or outputs without permission
- Share your account or circumvent tier limits
- Upload illegal, infringing, or malicious content
- Interfere with the service or attempt unauthorized access
- Misrepresent our estimates as official grades from any grading service
Do not present a GemRate Labs estimate as a professional grade in any sale listing. That harms buyers and it harms us.
We may suspend or terminate accounts that violate these terms.
8A. Automated Use
You may not use the Service to benchmark, harvest prompts, extract models, automate large-scale grading farms, or train competing AI systems using our outputs.
9. Our content
The service, including its software, design, text, and grading methodology, is owned by us and protected by intellectual property law. Your subscription grants a limited, revocable, non-transferable license to use the service — not ownership of anything.
Card images, player names, team names, and manufacturer marks belong to their respective owners. We claim no rights to them.
10. Third-party services and links
The service integrates with and links to third parties including eBay, Stripe, and professional grading services. We don’t control them and aren’t responsible for their content, availability, or practices.
Affiliate disclosure: some eBay links are affiliate links. We may earn a commission on qualifying purchases at no extra cost to you. This never affects what we show you.
10A. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including cloud outages, internet failures, cyberattacks, natural disasters, labor disputes, or governmental actions.
11. Beta and early-stage features
This service is under active development. Features may be incomplete, change without notice, or be removed. Data may be inaccurate. We may label features as beta or experimental — those especially should not be relied on for financial decisions.
12. Termination
You may stop using the service and delete your account at any time.
We may suspend or terminate your account for violation of these terms, non-payment, or if we discontinue the service. If we discontinue the service entirely, we’ll give reasonable notice and refund any prepaid unused portion.
On termination your right to use the service ends immediately. Sections 4, 5, 6, 7, 9, and 13 survive.
13. Disputes
Governing law: these terms are governed by the laws of Colorado, without regard to conflict of laws principles.
Informal resolution first: before filing anything, contact us at Contact@GemRateLabs.com. Most problems can be solved with an email.
14. Changes to these terms
We may update these terms. Material changes will be announced by email or in-app notice at least 30 days before taking effect. Continued use after that constitutes acceptance.
15. Miscellaneous
If any provision is unenforceable, the rest stays in effect. Our failure to enforce a provision isn’t a waiver. These terms plus the Privacy Policy are the entire agreement between us. You may not assign them; we may assign them in connection with a merger or acquisition.
